В статье исследуется правовая природа операторов услуг как субъектов финансового рынка и их роль в обеспечении финансовой безопасности Российской Федерации. Показано, что операторы формируют инфраструктурную основу современной финансовой системы, обеспечивая устойчивость расчётов, достоверность обмена данными и соблюдение требований законодательства. Анализ законодательства, судебной практики и научных публикаций позволяет сделать вывод о необходимости унификации правового статуса операторов, разработки стандартов внутреннего контроля и создания системы аккредитации. Обоснована концепция ответственного оператора как ключевого звена цифровой модели финансового контроля. Результаты исследования имеют теоретическую и прикладную значимость, а выводы могут использоваться при подготовке кандидатских диссертаций по финансовому праву
The article examines the legal nature of service operators as subjects of the Russian financial market and their role in ensuring national financial security. It demonstrates that service operators constitute the infrastructural foundation of the modern financial system by guaranteeing the stability of settlements, the reliability of data exchange, and compliance with financial legislation. Drawing on an analysis of Russian legislation, judicial practice, and recent academic literature, the study identifies the hybrid nature of service operators, who combine private-law status with public-law responsibilities delegated by the state. Their activities support the operation of payment systems, fiscal data networks, and electronic trading platforms, forming a digital framework for financial monitoring and state supervision. Special attention is given to the problems of fragmented regulation and inconsistent supervisory models across different branches of law. The author argues that the lack of unified standards of internal control, accreditation, and cybersecurity requirements undermines the predictability of financial oversight. The article substantiates the need for codifying the legal status of service operators within the forthcoming Federal Law “On the Financial Market,” introducing uniform control mechanisms and disclosure obligations regarding operational risks. The concept of the “responsible operator,” as developed through judicial practice and legal scholarship, is proposed as a cornerstone of a modern, technology-based system of financial control. The research results have both theoretical and applied significance: they may serve as a foundation for further academic studies and as a methodological basis for legislative improvement in the field of financial law and digital regulation
