In connection with the creation of a January 1, 2015 the Eurasian Economic Union (EAEC) was necessary to study characteristics of movement of cultural property across the customs border of the inter-state association. In the proposed article deals with the criminalization of smuggling of cultural property, which is set in the legislation of the five countries participating in this association. In this comparison of these problems are considered for the first time.

Пройдя период суверенизации, бывшие советские республики, а теперь независимые государства, начали объединяться в различные интеграционные сообщества. Так, было образовано Евразийское экономическое сообщество (ЕврАзЭС) как международная организация, в состав которой входили Республика Беларусь, Республика Казахстан, Кыргызская Республика, Российская Федерация, Республика Таджикистан и Республика Узбекистан.
1 января 2015 г. вступил в силу договор о создании Евразийского экономического союза (ЕАЭС), который образован в целях всесторонней модернизации, кооперации и повышения конкурентоспособности национальных экономик и создания условий для стабильного развития в интересах повышения жизненного уровня населения государств-членов. В ЕАЭС обеспечивается свобода движения товаров, а также услуг, капитала и рабочей силы, и проведение скоординированной, согласованной или единой политики в отраслях экономики.
