CENSORSHIP AS AN INTEGRAL PART OF RESTRICTIONS ON HUMAN AND CIVIL RIGHTS AND FREEDOMS IN THE RUSSIAN FEDERATION

Abstract (English):
In the modern Russian state, censorship is prohibited. At the same time, the Constitution of the Russian Federation allows for the possibility of exceptions. One of these exceptions to the general rule is the restrictions on human and civil rights and freedoms in the Russian Federation established by federal laws, which are either called censorship or literally coincide with the interpretation of the concept of "censorship". In modern society, censorship actually acts not only and not so much as a tool for controlling information, but, first of all, as a mechanism influencing democratic processes related to the need to restrict certain human and civil rights and freedoms in order to respect the rights and legitimate interests of others, as well as to protect the foundations of the constitutional order, morality, health, rights, ensuring the defense of the country and the security of the state. The article provides and comments on relevant excerpts from modern Russian legislative acts. The methodological basis of the research is the universal dialectical method of cognition. Along with it, general scientific and private scientific methods were used: comparative legal, concrete sociological research, formal logical, systemic, structural and functional, formal legal, axiomatic. As a result of the conducted research, a modern definition of the concept of "censorship" has been developed, which reflects current realities. The proposed formulations in the legislation emphasize the importance of not only studying, but also critically analyzing these categories. This approach allows for a better understanding of the dynamic changes taking place in modern society and a deeper understanding of their impact on human rights and freedoms.
