В статье рассматривается вовлечение как конститутивная уголовно-правовая категория, играющая ключевую роль в системе охраны прав и законных интересов несовершеннолетних. Ее целью является разработка теоретически обоснованного и юридически точного понимания категории «вовлечение» применительно к несовершеннолетним, а также уточнение ее уголовно-правовой природы, признаков, объема и отличий от смежных понятий (склонения, подстрекательства, вербовки) с учетом законодательной конструкции, научной доктрины и судебной практики. Автором выявлены три подхода к регламентации в тексте УК РФ термина «вовлечение», проведен семантический, доктринальный и практико-ориентированный анализ его сущности. Особое внимание уделено вопросу соотношения «вовлечения» и «склонения», моменту их окончания. В заключении определяются основные признаки вовлечения и формулируется авторское понятие вовлечения несовершеннолетних в совершение преступления, иных противоправных или антиобщественных действий.
The article considers involvement as a constitutive criminal law category that plays a key role in the system of protection of the rights and legitimate interests of minors. Its purpose is to develop a theoretically sound and legally accurate understanding of the category of "involvement" in relation to minors, as well as to clarify its criminal-legal nature, features, scope and differences from related concepts (declension, incitement, recruitment), taking into account legislative structure, scientific doctrine and judicial practice. The author identifies three approaches to the regulation of the term "engagement" in the text of the Criminal Code of the Russian Federation, and conducts a semantic, doctrinal, and practice-oriented analysis of its essence. Special attention is paid to the issue of the ratio of "engagement" and "declension", the moment of their termination. The conclusion identifies the main signs of involvement and formulates the author's concept of involving minors in the commission of a crime, other illegal or antisocial actions.
