В данной статье рассматривается развитие и распространение международных антикоррупционных инициатив, стандартов и руководств, приведена их классификация по типам в части применения к построению антикоррупционной программы организации. На основе анализа преимуществ и недостатков стандартов сделан вывод о негативном влиянии отсутствия должного регулирования на их эффективность в вопросах обеспечения подотчетности компаний ожиданиям общества
Th is paper assesses the proliferation of international anticorruption initiatives, standards, and guidelines. A comprehensive classification of different types of standards with regards to their applicability to anticorruption compliance program set-up is provided. Based on the analysis of benefits and shortcomings of standards, a conclusion is made that in the absence of a clear regulatory framework the effectiveness and efficiency of standards is limited, since they lack accountability per se.
ВведениеКоррупция, трактуемая в широком смысле как злоупотребление вверенными полномочиями в целях извлечения личной выгоды [1], является перманентной составляющей политической системы, поэтому едва ли может быть обозначена в качестве нового явления. К примеру, сохранились свидетельства, указывающие на повсеместное распространение коррупции в политической и судебной системах Древней Греции [2]. Подкуп судей в Древнем Риме принял столь значимые размеры, что стал обычной практикой. В своем историческом анализе индустрии железнодорожных перевозок XIX в. в США Ч. Пэрроу отмечает, что распространение коррупции достигало такого уровня, что следовало бы включить ее в список факторов производства, таких как земля, капитал, труд и предпринимательские способности [3, с. 141]. Одновременно с этим на протяжении веков национальные правительства с разной степенью эффективности осуществляли борьбу с коррупцией: принимались антикоррупционные законы, а нарушителей преследовали и даже казнили.Однако, совершенно новое прочтение тема борьбы с коррупцией получила в контексте нарастающего процесса глобализации мировой экономики [4, с. 10].
