    <p>Рассматривается одна из наиболее спорных концепций в современном международном праве — концепция «справедливой войны». В отечественной доктрине из-за значительной политизированности она практически не рассматривалась с правовой позиции. Однако западная школа международного права активно внедряет именно правовое измерение данной концепции. Особенность концепции «справедливой войны» состоит в том, что она, по сути, пытается узаконить применение силы в обход положений Устава ООН.&#13;

   <trans-abstract xml:lang="en">
    <p>The aims and goals of war have drastically changed during the recent decades. The prohibition of the use of force fixed in the Charter of the United Nations became a real challenge to many states. Nevertheless, we observe regular use of force in international relations. Though &amp;#34;classic&amp;#34; interstate wars became rather rare, the states continue to solve their political problems by exploiting the armed forces. In these circumstances it is problematic to explain the use of force from the legal point. That is why we talk so much about &amp;#34;preventive self-defence&amp;#34;, &amp;#34;humanitarian intervention&amp;#34;, &amp;#34;the responsibility to protect&amp;#34; and some other controversial concepts. One of the most disputable among them is a &amp;#34;just war&amp;#34; concept, which has practically not been analyzed in our domestic doctrine. However, the western school of international law is actively implementing precisely the legal dimension of the &amp;#34;just war&amp;#34; concept. Of course, the concept itself is extremely political, but the consequences of its practical implementation may have a great impact on contemporary international law, as it tries to legitimize the use of force in circumvention of the Charter of the United Nations. Because of the huge importance of the question, the analysis of the concept seems extremely actual.&#13;

  <p>В 1832 г. легендарный военный стратег К. фон Клаузевиц отмечал: «В каждом веке своя война, свои условия для ее ограничения и свои конкретные предпосылки для ее начала». Можно констатировать, что в XX в. война претерпела наиболее радикальные изменения за всю историю международных отношений. При этом, несмотря на довольно успешное функционирование Организации Объединенных Наций в течение вот уже 68 лет, очевидно, что международное сообщество не стало воевать меньше. Однако изменилась специфика конфликтов, значительное количество которых трансформировалось в конфликты внутренние, протекающие в рамках суверенных государств, в то время как основатели ООН исходили из превалирования межгосударственных конфликтов. Глобализация угроз, распространение международного терроризма также существенно изменили сферу безопасности.Главным достижением основателей ООН можно считать введение запрета на применение силы в международных отношениях, за исключением двух правомерных случаев — самообороны и по решению Совета Безопасности. Однако эта уже ставшая привычной схема постоянно подвергается попыткам пересмотра, дополнения или даже отмены. Одной из попыток подобного правового пересмотра является концепция «справедливой войны», которая всегда была довольно популярна, но не у юристов, а среди историков, политологов, специалистов в области международных отношений, политических философов, а также западных специалистов по христианской этике. Сфера гуманитарного знания, на которое концепция «справедливой войны» сегодня оказывает наибольшее практическое влияние, — это международное публичное право. Хотя некоторые специалисты полагают, что, наоборот, «международное право оказало сильное влияние на концепцию справедливой войны». В любом случае исторически «доктрина справедливой войны и международное право развивались одновременно».За последние 30 лет на Западе концепция стала одной из самых обсуждаемых, причем именно в контексте международного публичного права, о чем свидетельствует значительное количество публикаций по данной тематике. При этом можно констатировать, что в российской международно-правовой доктрине концепция «справедливой войны» достаточно редко упоминается именно в силу ее изрядной политизированности. В западной академической среде, где междисциплинарный подход применяется значительно интенсивнее, а коммуникация между юристами и специалистами в области международных отношений осуществляется гораздо активнее, количество публикаций юристов-международников, анализирующих концепцию «справедливой войны» именно с правовых позиций, весьма значительно. В историческом развитии концепции «справедливой войны» выделяются два этапа. Первый этап — собственно зарождение и развитие концепции в трудах таких выдающихся мыслителей, как Цицерон, Фома Аквинский, Блаженный Августин, Г. Гроций, Ф. де Виттория, Ф. Суарес и др. Второй этап — это последние 50—60 лет истории международных отношений, когда название «справедливая война» сохранилось, а содержание концепции было изменено, причем именно в правовом ключе. </p>
