Целью научного исследования в рамках данной статьи является анализ актов Фонда пенсионного и социального страхования РФ о взыскании денежных средств с должника-индивидуального предпринимателя как исполнительных документов и определение их места в системе исполнительных документов. Для достижения цели работы было уделено особое внимание нормативным правовым актам как источникам права, содержащих сведения о различных актах, принимаемых Фондом пенсионного и социального страхования РФ. В научном труде особо обращено внимание на отсутствие в открытых источниках анализа практики применения исследуемых исполнительных документов Фонда пенсионного и социального страхования РФ. В результате исследования приводится вывод о необходимости законодательного пояснения сути актов Фонда пенсионного и социального страхования РФ о взыскании денежных средств с должника-индивидуального предпринимателя как исполнительных документов и отграничения их от схожих по смыслу документов данного Фонда и актов иных властных субъектов.
The purpose of the scientific research in the framework of this article is to analyze the acts of the Pension and Social Insurance Fund of the Russian Federation on the recovery of funds from the debtor-an individual entrepreneur as executive documents and to determine their place in the system of executive documents. To achieve the purpose of the work, special attention was paid to regulatory legal acts as sources of law containing information about various acts adopted by the Pension and Social Insurance Fund of the Russian Federation. In the scientific work, special attention is paid to the absence in open sources of an analysis of the practice of applying the studied executive documents of the Pension and Social Insurance Fund of the Russian Federation. As a result of the study, a conclusion is made about the need for a legislative explanation of the essence of the acts of the Pension and Social Insurance Fund of the Russian Federation on the recovery of funds from the debtor-individual entrepreneur as executive documents and distinguishing them from similar documents of this Fund and acts of other government entities.
