LEGAL REGULATION OF FEDERAL PROPERTY MANAGEMENT IN THE FIELD OF HIGHER EDUCATION

Abstract:
The prospective development of the higher education system in our country is accompanied by large-scale modernization of the educational and laboratory facilities and campuses for students. In order to improve the efficiency of managing the property complex in the field of higher education, it is particularly important to improve the legal regulation of the activities of executive authorities that exercise the powers of the owner of federal property. This determines the purpose of the study, which is to identify gaps in the legal regulation of this area and develop proposals for improving regulatory legal acts. The author concludes that the legal regulation of property management in the field of higher education should take into account the specific features related to the social goals of the activity, as well as the uniqueness of the property in some cases. The author proposes to establish minimum standards for the provision of real estate in the implementation of higher education programs, which determine the actual need for property, as well as to unify the types of property that are considered particularly valuable and to increase the cost criterion for determining its value. The author also notes the lack of regulation regarding the joint use of property by two or more educational organizations, as well as the redundancy of legal norms regarding the assessment of the consequences of reconstruction and the transfer of real estate used in higher education by minors.
