This article explores the regulatory paradoxes inherent in preparing a criminal case for trial. Specifically, it identifies the regulatory paradoxes of the preliminary hearing, which is a complex process for preparing materials submitted to the court. The meanings of the preliminary hearing, which derive from the provisions of the current criminal procedure law, are identified. These are linked to the insufficient clarity of certain preventive issues that should preferably be considered and resolved before the main phase of the trial. At the same time, attention is drawn to the shortcomings and peculiarities of the regulatory framework governing the preliminary hearing. These are primarily rooted in the apparent semblance of these meanings. At the same time, the true harmonization of such meanings is only possible with jury trials. In this regard, the decision to hold a preliminary hearing is proposed to be attributed to the court's discretionary powers.
