ALTERNATIVE DOCTRINES OF THE CORRELATION OF EUROPEAN PUBLIC LAW AND INTERNATIONAL LAW
Abstract and keywords
Abstract (English):
The research contains a comprehensive study of doctrinal approaches to the correlation of international public and European public law, based on a multilevel, non-linear law. The paper features the role of positivism in the development of Public International law and European Public law and their modern versions, which were caused by globalization and European integration. The author reviews various domestic and foreign works in the field of European law. The study employs methods of systematic, comparative legal, and logical analysis. The author analyzes the theoretical basis for the specific ways and conditions of integration international law to European legal order. The author believes that the optimal theory of the correlation between international and European law should be based on the concept of integrative legal understanding. The research results can be used as a methodological basis for further studies of international and European law.
