The implementation of legal norms in Russia is still characterized by a number of “chronic” problems, including the incompleteness of legal regulation, conflicts, legal uncertainty and the lack of a uniform practice of application. The author notes that most of these problems can be solved with the help of a wider use by the state of legal means of smart regulation, in particular, expanding the scope of self-regulation, especially in the field of educational law and in the field of scientific research. The author tried to use the methods of system analysis and institutional approach to assess the effectiveness of the use of individual elements of self-regulation in such branches of Russian law as business and educational. The study assesses the use of self-regulation tools in the framework of the implementation of the norms of the Federal Law "On Self-Regulatory Organizations" dated December 1, 2007 N 315-FZ and the "Concept for Improving Self-Regulation Mechanisms" approved by Order of the Government of the Russian Federation No. 2776-r dated December 30, 2015. In the study, the author analyzed the statistical data of self-regulatory organizations, reports of state authorities, as well as the Report of the Ministry of Justice of the Russian Federation “On the results of monitoring law enforcement in the Russian Federation for 2021”. The author substantiates the advantages of using legal means of smart regulation and concludes that these tools can help overcome the incompleteness of legal regulation, conflicts of legal norms and legal uncertainty in the process of implementing the rules of law governing entrepreneurial educational and scientific activities on the territory of the Russian Federation. In the course of the study, the author formulated initial provisions confirming the hypothesis put forward at the beginning of the study that the elements of self-regulation, as legal means of smart regulation, have a positive impact on the process and results of the implementation of legal norms in certain branches of law.
