ABSTRACT

The article is devoted to searching for ways to ensure social justice for members of the humanities to improve the living standards of scientists. In this case effective means is to create a thesaurus database formalizing the humanitarian works conceptual apparatus. This approach enables the implementation of human science legal protection. Creation of humanitarian technology platform is possible on this basis.

1. Социальная несправедливость — налицо

Ученые-гуманитарии с точки зрения охраны прав на свои интеллектуальные продукты практически беззащитны по сравнению с представителями естественных и технических наук, у которых есть возможность опираться на патентное право. Гуманитарии могут опираться только на механизмы охраны и защиты авторских и смежных прав, которые практически не позволяют надежно охранять создаваемые произведения путем официальной их регистрации в государственных органах. Результаты такого научного труда в лучшем случае приравниваются к произведениям литературы и искусства. Однако гуманитариям это фактически ничего не дает [Бобков, 2013, 31, с. 3–6].

Средства массовой информации сообщили, что за соблюдением авторских прав проследит Федеральная служба по авторским правам. Предполагается, что новая служба займется контролем деятельности Российского авторского общества (РАО), Всемирной организации интеллектуальной собственности (ВОИС) и Российского союза правообладателей (РСП). Указанные организации в основном занимаются вопросами сбора авторских гонораров за массовую трансляцию или публикацию произведений композиторов, исполнителей, художников, писателей и т.п. Естественно, что какой-либо экономический эффект в данном случае возможен лишь в случае достаточно больших тиражей. Это означает, что для подавляющего большинства гуманитариев, публикуемые произведения которых, как правило, малотиражны,

такой механизм защиты авторских прав неэффективен. Это связано с тем, что для успешной защиты результатов интеллектуальной деятельности необходимо располагать действенным механизмом их охраны [Новоселов, 2013, 27, с. 29–33]. Налицо проявление социальной несправедливости: при прочих равных условиях, шансов на успешную охрану и тем более защиту результатов своей интеллектуальной деятельности у гуманитариев существенно меньше, чем у их коллег, представляющих иные научные или творческие направления¹ [Орлов, 2013, 28, с. 37–42].

¹ Социальная несправедливость в отношении гуманитариев проявляется в том, что в соответствии с новыми правилами присвоение докторских степеней представители гуманитарных наук должны опубликовать 15 научных статей в журналах, входящих в перечень ВАК, а их коллеги из сферы естественных и технических наук — всего по 10.
