The present study is devoted to the problematic aspects of legal regulation of preventive measure in the form of prohibition of certain actions. The author analyses statistical data illustrating the practice of election of preventive measures of judicial authorisation, on the basis of which he comes to the conclusion that the prohibition of certain actions as an effective alternative to detention is untenable. The author sees the solution of the mentioned problem in improvement of normative regulation of this institute, in this connection the list of existing contradictions, dualistic interpretations in the part of provisions of criminal procedural legislation regulating the order of application of prohibition of certain actions is given.
